Obtaining a special permit for subsoil use (geological study, development), Kyiv

According to the Resolution of the Cabinet of Ministers of Ukraine dated May 30, 2011 No. 615, the Procedure for granting special permits for the use of subsoil was approved, which regulates the issue of granting special permits for the use of subsoil (hereinafter - permits) within the territory of Ukraine, its continental shelf and exclusive (maritime) economic zone, and also determines the procedure for extending the term of validity, reissuing, issuing a duplicate, suspending or canceling the permit and making changes to it. This Order applies to all types of subsoil use. Issuance (refusal of issuance, reissue, issuance of a duplicate, cancellation) of a permit is carried out in accordance with the Law of Ukraine "On the Permit System in the Field of Economic Activity". Permits are granted by the State Geodrama to the winners of auctions for their sale and without holding auctions in the cases provided for in clause 8 of this Procedure by the State Geodrama, except for minerals of local importance on the territory of the Autonomous Republic of Crimea, permits for the extraction of which are granted by the Council of Ministers of the Autonomous Republic of Crimea in accordance with this Procedure. A separate permit is issued for each type of subsoil use within a specific area. The use ofland plots for the needs related to the use of subsoil is carried out by subsoil users in the manner established by legislation.

PERMITS ARE GRANTED FOR THE FOLLOWING TYPES OF SUBSOIL USE:
- geological study of mineral deposits
- geological study, including research and industrial development of mineral deposits of national importance.
- mining of minerals
- geological study of oil and gas-bearing subsoils, including exploratory and industrial development of deposits, with further extraction of oil and gas (industrial development of deposits)
- construction and operation of underground structures not related to the extraction of minerals, including structures for underground storage of oil, gas and other substances and materials, disposal of harmful substances and production waste, waste water discharge
- creation of geological territories and objects of important scientific, cultural, sanitary and health importance (scientific training grounds, geological reserves, nature reserves, natural monuments, medical and health facilities, etc.)
- performance of works (implementation of activities) provided for by the agreement on product distribution

The permit is granted for the term:
3 (three years) - for the geological study of subsoil areas of local significance
5 (five years) - for geological study of mineral deposits and geological study, including research and industrial development of mineral deposits of national importance
10 years - for geological study of oil and gas-bearing subsoils, including research and industrial development of oil and gas deposits, within the continental shelf and the exclusive (marine) economic zone of Ukraine;
20 years - for the extraction of minerals
30 years - for oil and gas extraction within the continental shelf and the exclusive (marine) economic zone of Ukraine

The period of validity of individual permits for the geological study of oil and gas-bearing subsoils and oil and gas extraction (industrial development of deposits), but for no more than 20 years on land and no more than 30 years on the continental shelf and within the exclusive (marine) economic zone of Ukraine - for geological study of oil and gas-bearing subsoils, including experimental and industrial development of deposits, with subsequent oil and gas extraction (industrial development of deposits). At the same time, the period of geological study of oil and gas-bearing subsoils cannot exceed 10 years.
20 years - for the construction and operation of underground structures not related to the extraction of minerals
50 years - for the construction and operation of underground oil or gas storage facilities;
the term of validity of the relevant product distribution agreement is for the execution of product distribution agreements.

For the granting of a permit without an auction, a fee is charged, which is calculated based on the initial sale price of such a permit at an auction in accordance with the Methodology for determining the initial sale price at an auction of a special permit for the right to use subsoil, approved by Resolution of the Cabinet of Ministers of Ukraine dated October 15, 2004 No. 1374 (Official Gazette of Ukraine, 2004, No. 42, Art. 2772; 2006, No. 45, Article 3014).

To extend the validity period of the permit, the subsurface user submits the same documents as for obtaining a permit without holding an auction.
